How we collect, use, and protect your personal data in compliance with GDPR, CCPA, and other privacy laws.

This Privacy Policy describes how Sellestial, Inc. ("Sellestial," "we," "us," or "our") collects, uses, and shares Personal Data when you visit or interact with any website we control that links to this Privacy Policy (collectively, the "Website"), engage with our marketing communications, or apply for a job with us. This Privacy Policy is a public notice only; it is not part of our SaaS Subscription Agreement, Master Services Agreement, or Data Processing Addendum, all of which govern our processor-side SaaS and professional services.

1. Definitions

1.1 "Personal Data" means any information that identifies, relates to, describes, or can reasonably be linked to an identifiable individual, as defined under Applicable Privacy Laws.

1.2 "Applicable Privacy Laws" means the California Consumer Privacy Act (as amended by the CPRA), the EU & UK General Data Protection Regulation, and any other data-protection or privacy laws that apply to our processing activities described in this Privacy Policy.

1.3 "Website" means https://sellestial.com and any sub-pages or microsites that display or link to this Privacy Policy.

1.4 "Services" means our publicly available marketing content, webinars, events, newsletters, and recruiting portals that are not governed by separate contractual terms.

1.5 "Cookies" means small data files placed on your device or browser when you visit the Website, including similar tracking technologies such as pixels, tags, and local storage.

1.6 "You" or "your" means any visitor to the Website, recipient of our marketing outreach, or job applicant who provides or whose Personal Data is collected by us under this Privacy Policy.

1.7 "Cookiebot" means the consent-management platform operated by Cybot A/S that enables visitors to give or withdraw granular Cookie consent on the Website.

1.8 "Exact Visitor ID" means Sellestial's first-party visitor-identification service that sets a unique Cookie to recognise returning browsers and enrich visit data with business-contact information.

2. Scope & Relationship to Other Documents

2.1 Scope

This Privacy Policy applies solely to Sellestial's role as a controller of Personal Data collected through the Website, marketing channels, and recruiting processes. It does not apply to Personal Data we process on behalf of customers through the Sellestial SaaS platform or professional services; such processing is subject to our Data Processing Addendum ("DPA") and related agreements.

2.2 Relationship to DPA & SSA

Where a customer accesses our SaaS or services, the SaaS Subscription Agreement ("SSA"), Master Services Agreement ("MSA"), and DPA govern processor-side processing. Those documents take precedence over this Privacy Policy with respect to customer-submitted data in the platform.

3. Information We Collect

3.1 Information You Provide Voluntarily

  • Contact Forms. Name, business email, phone number, company, job title, message content, or any other data you choose to submit.
  • Event & Webinar Registrations. Registration details such as name, email, company, and session preferences.
  • Marketing Preferences. Opt-in choices, survey responses, or content interests.
  • Job Applications. Resume/CV, cover letter, employment history, education, LinkedIn profile, compensation expectations, and any information you supply during the hiring process.

3.2 Information Collected Automatically

  • Device & Usage Data. IP address, browser type, operating system, referring URLs, pages viewed, links clicked, and the date/time of each visit.
  • Cookie Data. Unique IDs, session information, preferences, and analytics data collected through Cookies (see Section 5).

3.3 Information From Third Parties

  • Social & Professional Networks. Public profile details (e.g., LinkedIn) to enrich leads or job-candidate profiles.
  • Lead-Generation Partners. Business contact data licensed from reputable providers for B2B outreach.

4. How We Use Information

  • Provide & Improve the Website. Operate, maintain, debug, and enhance Website performance and user experience.
  • Marketing & Sales Outreach. Send newsletters, product updates, promotional emails, LinkedIn messages, or event invitations where permitted by law. You may opt out at any time.
  • Analytics. Measure Website traffic, campaign effectiveness, and user engagement to refine content strategy.
  • Recruiting. Evaluate candidates, schedule interviews, and make hiring decisions.
  • Security & Fraud Prevention. Detect, investigate, and prevent malicious or unauthorized activities.
  • Legal Compliance. Comply with applicable laws, regulations, and lawful requests, or enforce our rights.

5. Cookies & Analytics

5.1 Overview

We use first-party and third-party Cookies-including those managed through the Cookiebot banner-to recognise your browser, remember preferences, measure traffic, and personalise content. You can accept or reject each non-essential Cookie category at any time via the banner's "Change Consent" link in the page footer.

5.4 Third-Party Services

  • Loom: Video recording and embedding services.

6. Sharing & Disclosure

Service Providers

We share data with third-party service providers who process Personal Data strictly on our behalf and under written contracts. These include:

  • Visitor Identification: Sellestial, Inc. (Exact Visitor ID). Sellestial engages Vector, Inc. (USA) as its sub-processor.
  • Consent Management: Cookiebot by Cybot A/S (cookie-consent banner).
  • Analytics & Marketing Platforms: HubSpot (CRM and marketing automation), Google Analytics (website analytics).
  • Customer Messaging: Intercom (chat widget and customer support).
  • Content & Media Services: Loom (video recording and embedding).
  • Infrastructure Providers: Cloudflare (security and content delivery), Akamai (bot management), cloud hosting providers.
  • Other Business Services: Email delivery, recruiting platforms, and similar vendors.

Professional Advisors. Lawyers, auditors, or insurers when necessary for legitimate business purposes.

Legal & Safety. Competent authorities or other parties when required to comply with law, protect rights, or prevent harm.

Business Transfers. In connection with a merger, acquisition, financing, or sale of assets involving Sellestial, subject to confidentiality protections.

We do not sell Personal Data or share it for cross-context behavioral advertising, as those terms are defined under the CCPA/CPRA.

7. International Transfers

Sellestial is a U.S. company with global visitors. Where Applicable Privacy Laws require, we rely on appropriate safeguards-such as Standard Contractual Clauses, UK International Data Transfer Addendum, or recognition under the EU-U.S. Data Privacy Framework-to lawfully transfer Personal Data across borders.

8. Data Subject Rights

8.1 EEA & UK Individuals

If you reside in the EEA or UK, you may have the right to access, rectify, erase, restrict, or port your Personal Data, and to object to certain processing. To exercise these rights, email info@sellestial.com with "Privacy Request" in the subject line. You also have the right to lodge a complaint with your local supervisory authority.

8.2 California Residents

California residents may request (i) disclosure of categories and specific pieces of Personal Data we collected, (ii) deletion, and (iii) information about our data practices. We will not discriminate against you for exercising CCPA/CPRA rights.

8.3 Verification & Response

We will verify your identity before fulfilling a rights request and respond within the timelines required by Applicable Privacy Laws.

9. Security

We employ administrative, technical, and organizational measures designed to protect Personal Data from unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is 100% secure; therefore, we cannot guarantee absolute security.

10. Data Retention

We retain Personal Data only for as long as is necessary to fulfill the purposes outlined in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce agreements. Criteria include the nature of the data, our legal obligations, and business needs.

11. Children's Privacy

The Website is not directed to children under sixteen (16) years of age, and we do not knowingly collect Personal Data from such children. If we learn that a child has provided us with Personal Data, we will delete it without undue delay.

12. Third-Party Links

The Website may contain links to third-party sites or services. We are not responsible for the privacy practices of those third parties, and your interactions with them are governed by their own privacy policies.

13. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the revised version and update the "Effective Date" above. Continued use of the Website after changes become effective indicates acceptance of the updated Privacy Policy.
